1. Definitions

• “Company,” “we,” “our,” “us” – OptiBPO.
• “Member” / “Referrer” – An individual who joins the program via https://cap.optibpo.com and shares their unique referral link.
• “Referral” – A person or organisation that (a) is not an existing lead, prospect, or customer of the Company, and (b) is submitted through the Member’s unique link.
• “Qualified Meeting” – A live meeting (minimum 15 minutes) between the Referral and a Company sales representative, held within 90 days of submission.
• “Qualified Customer” – A Referral that signs a services agreement and pays its first invoice within 6 months of submission.
• “Program Site” – The portal where Members join, track activity, and receive rewards (currently https://cap.optibpo.com).

2. Eligibility

• Members must be 18 years or older and legally able to participate.
• Employees, contractors, or immediate family members of Company employees are ineligible unless expressly approved in writing.
• Participation must comply with all applicable laws in the Member’s jurisdiction; the Program is void where prohibited.

3. How to Refer

• Join the Program Site and obtain your unique referral link.
• Share the link only with contacts who may have genuine interest. No spam, bulk messaging, or posting to coupon sites.
• The Referral must use your link to submit the inquiry form; manual or retroactive claims will not be accepted.

4. Rewards

*Processing times may vary due to verification and compliance checks. All amounts are stated in Australian dollars (AUD) unless noted otherwise.

5. Reward Conditions

• Rewards are personal, non-transferable, and may not be substituted, sold, or exchanged.
• Credit is awarded to the first Member whose link is used (“first-touch”).
• Self-referrals, duplicate leads, or Referrals from the Member’s own organisation are ineligible.
• Members are responsible for all taxes, fees, or charges imposed on rewards.

6. Prohibited Conduct

Members must not:

• Misrepresent their relationship with the Company or make false claims.
• Employ spam tactics, purchased lists, bots, or misleading domain names.
• Offer incentives or guarantees beyond those published by the Company.
• Breach any law, including (without limitation) the Spam Act 2003 (Cth), the Australian Consumer Law, GDPR, CASL, or CAN-SPAM.

Violations may result in immediate disqualification, forfeiture of pending rewards, and termination of the Member’s Program account.

7. Program Changes & Termination

The Company may modify, suspend, or terminate the Program—or any Member’s participation—at any time and for any reason. Continued participation after changes constitutes acceptance of the revised Terms.

8. Limitation of Liability

Nothing in these Terms restricts or modifies any rights you may have under the Australian Consumer Law that cannot be excluded. Subject to those non-excludable rights and to the maximum extent permitted by law, the Company is not liable for:

• Lost profits, revenues, or data;
• Indirect, special, or consequential loss; or
• Matters beyond its reasonable control.

Our total liability in connection with the Program will not exceed AUD 100 or the total rewards paid to you in the preceding 12 months, whichever is greater.

9. Governing Law & Dispute Resolution

These Terms are governed by the laws of New South Wales, Australia, without regard to conflict-of-law rules. Any dispute arising out of or relating to the Program will be resolved exclusively in the courts of Sydney, NSW.

10. Acceptance

By registering as a Member or submitting a Referral, you confirm that you have read, understood, and agree to be bound by these Terms and any additional rules on the Program Site.
